The UCMJ protects military personnel when they have a moral and legal obligation to the Constitution and not to obey unlawful orders and the people who issue them. This order is in direct violation of the Constitution, Nuremberg Code, and the UCMJ.
It won't help them. UCMJ holds you to more liability as well as more severe consequences. a civilian doesn't want to get a jab at work? no worries, worse that will happen is you lose that job. Shit doesn't happen like that in the military. punishments are swift and severe. Sure if you witnessed your unit committing some crime UCMJ will protect you for disobeying an order. It doesn't apply here. I'm not saying you are wrong, I'm just saying it will take years and the damage that was done to that soldier is already done. Do you know how damaging a dishonorable/ bad conduct discharge is? that's scarlet letter shit. he'll the VA just now admitted that they will now compensate vets who were around burn pits. Only took them almost 20 years.... don't hold your breath
No doubt, the Big Chicken Dinner is a career stopper, but my thought was that this would be rejected at the command level, e.g. illegitimacy of orders from occupying forces.
The way I look at it, the only way anything could be done is if the troops called their state representatives in mass. Otherwise if they decided that they will just ignore directives from command they will be removed. Here is an example. I was stationed somewhere where the soldiers had a blackmold issue in the barracks. it was brought up through the proper channels and nothing was done about it. Well some soldiers took it upon themselves to take video and report it to the local news. Now the base has egg on their face, has to answer questions. There were mass cleanings, Command Sergeant majors from brigade level and above walking through the rooms "inspecting" the cleaning. Sure the situation was resolved, however some people that did the right thing were now gone from our unit. The jab situation has no precedent, ands these troops have very little options.
