D-mn-d hypocrisy! Release the Jan 6 detainees first- Indefinite detention violates the Fourth through Eighth Amendments! GITMO folks have already been tried!

Didn't Obama's NDAA (National Defense Authorization Act) allow for the indefinite detention of American citizens without bringing charges if the citizens were deemed by the govt to be a terrorist threat? I was appalled when NDAA was signed into law and conservatives weren't saying much about it.

Also, maybe a stupid question, but how is it possible that any law, such as NDAA, is successfully upheld when it violates the liberties protected in the Constitution? Doesn't the Constitution trump subsequent laws passed? I don't understand why our courts would uphold any law that contradicts the Constitution.

The courts are corrupt, at least many of them. Legally, you are are right, but in practice that is not how it works.
