I also absolutely agree with the idea behind the lawyer's statement. It would be an unlawful shooting if said shooting really occurred.

Huge flash, way more than if bullet was fired, and faked recoil because blanks have zero recoil.

Well since it never made it to court, there is still a chance for a future murder charge. No double jeopardy.
