He may have to submit to weekly testing as a concession to not being jabbed - but there may be grounds to object to even that. All the information that has been posted on these boards has been put there for people to help themselves. There is not much an attorney will do unless their services are needed as part of a class action on behalf of several others.
First I would suggest knowing what the impact on retirement benefits are with regard to being fired versus quitting due to refusing to be jabbed. Weekly testing is being offered by some companies as an accommodation to vaxxine refusal and exemptions. This gets them off the hook legally. Until some of this is sorted out by other court cases we are in no man's land. The vaxines available are still under EUA only and are not approved. Comirnaty is not available in the US. There may be some concern with regard to the testing as well. I would investigate those.
I am far from an expert, but where retirement benefits are concerned, getting fired for insubordination and the like are not good. I know many unfortunate souls that were framed by their bosses in the last year before retirement just so the benefits did not have to be paid. I would suggest securing that investment prior to deciding which course of action to take. The fact that this is occurring tomorrow doesn't allow any time to develop defensive strategies.
