My daughter bought tickets for a concert about 3 months ago. At the time, there was no mention of vaccine or mask requirements.
Now she gets informed she can only attend if she is vaccinated. They have an "All sales are final" statement, but I feel this last minute change could be seen as a breech of contract.
Are we basically screwed and charged by the system now for not complying?
Call your card company or bank and do a chargeback that at least that's what I would do
Yes, ask the company to refund the money. This will seed an incident that they will have to say happened when the credit card company calls.
Chargebacks are AWEFUL for the company. They get like 10. Not a year, just 10 (may differ based on payment processor). They cut off from running cards against that payment processor. It is truly awesome.
Lol I've worked retail and customer service for a long time, so I've learned a thing or two but I didn't know until you just mentioned it the impact that a charge back will have on a company
Yeah, I got to work for a company that had a service they rebilled for. They almost went under due to a payment processor cutting them off. We got 10 CC processors after that.
Some required YUGE deposits. Get a chargeback and they hold like 1 year's worth of your rebilling money or 3 months. Enough that you hold the bag for any extra chargebacks and NOT THEM.
So we profiled account sign-ups based on all sorts of rules we learned while getting kicked in the shins. If CC processor cuts you off, you will never get them back.
CC company wants to know you tried to resolve this. Let WokeBrokeCorp know they owe a refund for any valid reason; terms change in this case. I have had a few WokeBrokeCorp say they will refund or cancle and not follow through. GOTCHA! Get some names and data as you go through this. Then let the CC company know why you deserve the chargeback. 'I canceled/tried to cancel, ask for a refund before shipping, ...'
Sort of Thors hammer lol.
It is breach of contract. If they don't refund the money, take them to small claims court and sue them to recover the money and court costs.
That's how I feel about it, but I'm no legal opinion.
I seriously miss live music. I generally do 10 to 15 shows a year. I will not spend a dime on tickets until this shit blows over and I know I am not alone. The venues are who is doing it saying the artists are demanding it. There are a select few douchebags that I would not go see anyways that are screaming loud making us think it is industry wide. It is not. At this point I have about a year left on over 1000.00 in credits at Live Nation from cancelled shows at the beginning of this shit. Hopefully I am able to use them eventually. I mean, if they are not selling tickets and only a few Karen's and Kevin's show up the talent is going to speak up or they will simply get off the road again, which will hurt the venues. No people, no merch sales. And merch is where they make 1/2 their paycheck.
Sorry for the rant
Without being able to read the terms and conditions of the exact ticket/broker/company, people can only speculate.
It's a shame because we did look all over for the wording or even the word vaccine, I can admit the fine print was not combed through.
Do you have a lawyer friend who could write them a nasty letter claiming breach of contract?
What concert?
Unfortunately for the whole business I absolutely refuse to purchase tickets for this very reason. You just have no way of knowing what craziness will be going down by the time the event occurs. I would only go to events that sold tickets at the door. Then at least you know the rules before you pay.
