If the "seizure" of American territories could be said to have occurred on Nov 3rd, when they stole the election (a factual act of war) then it could happen as soon as Nov 3rd, by the Jhartz post's logic.

Not sure if that holds for a military court, but if they are playing cautious you may be right on the Jan 20th, 2022 estimate... Which is depressing as hell...
