I believe getting or NOT getting a needle in ones body falls under "a description of healthcare you have received" any thoughts from frens?
Of course HIPAA should protect your PHI, that's it's purpose. It's irritating that Democrats fought hard for that law so that employers could not discriminate on the basis of health status and pre-existing conditions. And now they pretend it doesn't exist. There should be so many lawsuits.
Yes you are right, but there is no law anymore. The system is broken beyond repair.
If they were interested in following the law, yes, HIPPA would prevent your vax status from being disclosed. But they've already decided they aren't going to follow the Nuremberg Code, so, yeah, they're all going to swing.

HIPAA protects your information from being disclosed by your doctor to a third party without your permission. That's it. No further than that.
It does not protect you from your job asking you directly about your health information. It does not protect you from the government from asking you about your health information.
There are other laws, usually local, that may offer that sort of protection, but many of them specifically exempt vaccines. You'd need to research your local laws to figure that out.
But unless a third party is asking a medical professional or someone privy to your medical information (like HR) about your medical information, HIPAA is not the law that is going to apply.
Absolutely protects from ANY THIRD party accessing your PHI WITHOUT CONSENT. you must sign waivers to have a third party or "person" gain access to your PHI, your emoyer CANNOT access without your express written consent. PERIOD. ANY OTHER WAY IS ILLEGAL.
