Prosecutor is trying to force judges hand for a mistrial. Yes, the prosecution is losing that badly. Doing whatever is needed to delay and stop Kyle from being a free man.

I saw the Defense say something about a mistrial with prejudice, which my non lawyer brain would interpret as the state would not be allowed to take another shot at Kyle… but would that leave him vulnerable to other legal harassment?
