Because a mistrial means he hasn't been found INNOCENT. It's just a failure of the court trial... and he can be re-prosecuted at any time in the future. They would be trying to save face for prosecuting someone unjustly. Also, a mistrial might head off Rittenhouse's ability to SUE the city or county for what they did.
An honest judge wouldn't allow that.
Not if the case is dismissed with prejudice
either way not an aquittal so the media will push he was guilty and got off on technicality.
