The only time I sat on a jury was for an assault and battery case. The weapon used was a baseball bat. During the opening arguments, the prosecutor held up Louisville Slugger. During the trial, we found out the bat used was one of those little souvenir bats. More like a Billy club. Still inflected a lot of damage, but if the true slugger had been used, the result would have been like that scene in the Untouchables and there would not have been a victim left to testify. It was very theatrical. As a juror, I felt it was manipulative. I would not be surprised if this jury feels the same way. The prosecutor reeks of desperation.
