The Sixth Circuit is comprised of a majority of Republican President-appointed judges, which some view as friendly to the petitioners’ arguments.
According to American Thinker in 2017, there were 11 Rs and 5 Ds. It wrote the following:
I understand though a lottery of 3 judges are going to initially decide on this case. The way I understand how this works is it is like a PowerBall lottery using a ping pong ball that decides who the judges are. Crazy No?
So, the way it stands is a 2.2 to 1 ratio of selecting an R judge. If it somehow is bad luck and majority Ds are selected, the case will be motioned fora full court review, which is conservative according to American Thinker.
As a note, there are 16 Judges on the 6th Circuit Court of Appeals. However, there are listed a total of 27 on their website. Why is that deceiving? Because technically there are only 16 spots on the court.
So why are there 27 judges currently serving on the court if there are only 16 judgeships? Well, that is because of another position on the court known as senior judge.What is a senior judge? Essentially, a senior judge is a judge who decides to retire but continue working.
So who is the senior Judge? Well, there are 8 senior judges and a chief judge. All of them but 2 were appointed during an R administration.
In conclusion, there are only 16 spots on the Sixth Circuit bench, but because of the senior judge position there are actually eight more judges working and drawing equal salary as the active judges. This brings the total number of the Sixth Circuit judges to 27.
What's the chances of the 6 circuit over turning the 5th?
Wouldn't it go up to the supreme court if there is a challenge to the ruling?
I believe so.
I just get nervous as this keeps bouncing to other courts. The deep state will do what they have to do to get this overturned.
Hopefully we catch a break and the 6th circuit court does what's right. Not gonna hold my breath though.
