I think the point is that if him having said it as a private citizen means he's not immune, then you can't also penalize him on the basis of being President now. It's one or the other, can't have your cake and eat it too so to speak.

What law was it that Harris was violating advocating, while VP, for people running for office? I think it was McAullife? Not sarcastic but a real question because if she can’t vouch for candidates while in a position of power then I’d assume there are other mechanisms in place to the same effect for Biden in relation to an ongoing trial.
