After reading this my take distilled down to it's simplest form is that SCOTUS probably wont take the case and that would be the collapse of the 3rd branch of government since the other 2 have already collapsed and this is when the military comes into play. Trump want to exhaust every single legal and constitutional option before pulling the military option.
