If you ask me it depends on a few circumstances. If that's my house, and he is threatening me, and then tries taking my weapon.. He is attempting to possess it. Throw in his state of mind.. his prior threat.. yes this is justified.
not justified. the man was merely pushed away, and was not in imminent danger. he will get off simply because he is ex husband of a judge. his lack on concern for the man shot after the shooting tells alot about state of mind. in the court of public opinion, I find him guilty.
Seems planned. He was supposed to be there at 3:15 to pick up his son. His son wasn't there. He's justified at that point getting upset. A gun for (protection,) was not warranted.
Regardless of this incident, a wider lesson to learn here is this: As more and more states are relaxing laws on firearms and going to Constitutional Carry (which I heartily endorse, by the way) we must always keep in mind that confrontations that USED to involve merely words and physical encounters can now turn into lethal, life-ending incidents.
I have often repeated the old adage that "An armed society is a polite society." The corollary to that adage is, "An armed society is not very friendly to impolite people." This reality is showing itself more and more these days, and will continue until people learn to be polite as they see these events happen. It may take awhile for that to settle in to the public consciousness.
Be on your guard for such incidents in your own lives. Keep your head on a swivel, avoid confrontations if you can, and if you carry, MAKE DAMNED CERTAIN that you keep any armed response within the law. You will be judged by the cops, a jury perhaps, the public most definitely, and your entire life will be examined under a microscope.
Bad situation, We do not know the prior history between these guys. Does the dead guy have a violent past? Has he been violent towards the smaller guy, or the wife? In the video he tried to take shooters gun, assaulted him physically by tossing him across the yard. To me it's self defense, but shouldn't have been. I can totally see a manslaughter thrown on this. The bringing the rifle out that soon was a bit too much, and escalated the situation.

To me, the lady taking the video seems too calm after her man is lying on the ground dead or dying.
Since it's the woman not following the terms of the custody agreement, this will all slide.
