Someone please explain to me why it wasn’t illegal to do tests on orphans and when they died, he wasn’t charged with murder?

Probably because is was done in secret, like the other experiments on people (Tuskegee etc).

orphaned, abandoned, and otherwise unprotected children are at the mercy of whoever they come in contact with. Who says that foster children should have medical procedures done to them? Who has the authority to give consent?
