The FDA not sending in a rep is HUGE. There is nothing that will piss off a judge more than total disrespect for the court. By not showing up, the FDA’s reply is now meaningless. Interestingly, the initial brief focused more on Pfizer and they were presented as a child screaming “it’s not fair”, companies don’t get to say they won’t pay taxes or follow environmental laws bc they don’t have enough people. The outcome of the case will be telling. I feel in some ways that the courts are following devolution but then you have judges filing nationwide injunctions and some of my faith is restored. Another wait and see I guess

Normally, yes. Unless in this case it’s more arrogance, acting like there’s nothing to fear.
Sort of like the arrogance of running the two least likeable candidates for President just to prove you have the might to “win” regardless.
