100 Can some LawFag please explain to me how the 6th Circuit is even allowed to overturn the 5th Circuit? I though only a higher court could do that. If not then why doesn't the 5th circuit just over-overturn the 6th right back? If you have conflicting rulings in separate districts then the Supreme court can then settle the matter. This takes time and they are trying to beat the clock.
