So do you need a lawyer for this? How are you funding it if you don't mind me asking? I'd love to take California to court for falsifying Food stamp claims....but I don't have the cheddar to do anything about it, I thought.
I caught the CA Franchise Tax Board running an embezzlement/racketeering scheme. I was told that the only way they would stop this scheme is if a judge orders them to stop. I consulted 3 attorneys, who quoted me $100k, $300k and $800 k, and all I would get is the glory of stopping corruption. I decided to represent myself. I figured it was better to try and fail than not try at all. That is a civil case, using statutory law.
The overcharging of interest came out in the records that FTB submitted in the court case. Since overcharging interest is a criminal matter, all I can do is file the Complaint with the various oversight agencies and hope they execute it. I can't make them execute on it. This Complaint utilizes Common Law, which is similar but not the same.
At this point, I am hoping that I inspire more people to request copies of their records and catch overcharges. The more people who catch the crime and report it, the more likely the oversight agencies are to execute on the Complaint.
CA has made it VERY difficult to sue them. There are rules about having to execute every available administrative option before you can file. The bureaucracy they demand is so overwhelming that most people give up and go away. If you want to PM me, we can talk more about all the hoops you will need to jump through to get to the point where you are allowed to litigate.

I want to clarify something that I wrote above... the FTB says that the embezzlement/racketeering scheme that I caught is legal based on their interpretation of the law. I am arguing it goes against the law. Since it is a debate about interpretation of law, that is why it is a civil matter.
The overcharging of interest is a criminal matter because there is no debate about whether they are allowed to falsify records to make it look like you owe more than you do.
