If the Judicial Branch actually operated how it was outlined to do so within the Constitution - we wouldn’t be concerned.
Basically Congress has ceded away too much of its power. Power of the purse. Power to stop an Activist Judicial Branch that isn’t ruling on the Constitutionality of Law passed by Congress has been repeatedly tossed away by Congress.
Congress has to assert that Federal Courts can not enact law or set the merits, weight, or specifics of how a law works. That’s what Congress was designed to do. Too often we see Congress allow Federal Courts to set this precedent that they, in turn, allow - outside of the Constitution.
The problems we have are due to DC refusing to actually follow the Constitution.
Good question. Thank you for asking me to elaborate.
It’s actually amazing how well thought out the Constitution was. I mean given they were largely worried about monarchies - they were also smart enough to realize the dangers of Communitarianism which is the basis for Communism / Socialism / NWO.
