Such division of power is one of those funny little quirks built into the constitution, that allows for militia, so that the Federal army does not become a usurping force. Decentralisation is the trend in a digital world, as much as some centralist thought leaders try to scrape the old hierarchies under their bums. However, will this cause civil war? Only if the Constitution is abandoned. The political Right wants to keep those laws in place. So the Leftists suddenly fear this, because they can't trust themselves not to attack in their bitterness against decentralisation. But they will be culpable if Civil War 2.0 breaks out, much as they blame those who essentially follow the rules as the founding fathers intended.
