Perhaps Lincoln got the needed approval from DHHS? I don't know, speculating.

No, what happened is Lincoln had a Health Dept before the State Health Dept. was created. Basically, Lincoln said hey, we were first so we dont have to listen to the State and we can go it alone. The state never challenged.
