There’s been lots of rulings back and forth while it’s gone through the process. I read legal all day. I had missed the fifth circuit ruling in NOLA that made the stay just for the states suing. For now, the mandates for healthcare workers will stand (same for OSHA) BUT it will be appealed. I’ve been turning this over in my head and reading. Need to read with better clarity tomorrow. The OSHA ruling will likely stand with the 6/4. OSHA concentrates on occupational hazards. Covid is everywhere so you can’t say it’s only hazardous in the workplace. Thus OSHA doesn’t have the ability (or authority) to require a vax.
The things about the healthcare workers is a little different bc it concentrates on CMS, which oversees a federal program. One thing I keep going back to is that one of the challenges was that they did not adequately consider alternative. Watching mainstream media backpedal and all the information about alternative treatments come out has me wondering if this isn’t all part of the movie. We hear daily the hospitals being overrun, stories about vaxed workers being allowed to work with covid. Logically, if the ruling was based on the protection of the patients both of those things should be considered since there are alternatives like ivermectin and vaxed are able to get and spread. I think they have a decent shot at appealing this? Sorry for the paragraph. Thinking out loud I guess.
Hey thanks for clearing that up. I thought I was having dejavu bc I remember last month we were celebrating some Supreme Court ruling that it wasn’t constitutional. But of course there’s the state supreme and then the fed supreme. Maybe that’s where I got confused. It was the Louisana Supreme Court last month right?
Louisiana’s attorney general filed the original case. Other states joined.
