I’m not saying it’s right, I’m simply saying it’s not a violation of HIPAA. No, you don’t have to give it but asking or, as you state, trying to compel, isn’t a violation of HIPAA.
Is it discrimination? Because requiring unvaxxed to wear masks and test weekly while not requiring the same for vaxxed seems like they are singling out people for discrimination. The unvaxxed being the only ones walking around the office with the "shame" of their decision right there on their faces.
Unfortunately it’s not even discrimination unless it’s against a protected class. Again, not saying I agree (I refused to comply with vaxx requirements at my job), just saying that’s legally how it is.
