Great question. What you are referencing is the EO that cuomo made. He signed an Executive Order attached to the declared state of emergency regarding the pandemic that enables businesses to enforce masking just like they would for shirts and shoes. That has long since expired.
But, if you read carefully the court's decision here (which aparently not many people have), the court has found a problem with the way in which hochul enacted the mandate. She did not actually make an executive order, it was a decree; but every one fell for it. After cuomo was making EOs left and right the state legislature signed into law that all EOs and EO extentions regarding the pandemic need to be run by them, the legislature. hochul did not do that and thus this ruling. There is a good chance hochul will go through the proper hoops this time and the very democrat legislature will accept it and the mandate could come back.
