I believe the emergency stay is 'till Friday when the court will hear the letitia james appeal. If the court has any brains they'll strike down her appeal and uphold the decision. It clearly is unconstitutional the way hochul went about this. There was a law the legislature passed that requires governors to seek approval of the legislature to issue or update EO's & dictates (in regards to the pandemic). And it was passed while she was Lt. Governor.
This whole thing is about the manner in which the mandate was enacted, nothing to do really with the masks. If the court upholds the decision, hochul could still enact the mask mandate by going through the proper hoops according to NYS law.
The court is essentially saying here "you can't just tell every one to wear a mask and expect it to magically be a lawful order" which is what she did in regards to masks.
