It might be most effective to do both the questioning and the video, but check the laws in your state first.
In a public setting there is no expectation of privacy... Schools have cameras everywhere so there is no expectation of privacy...
The issue isn't so much privacy as it is some states do not permit recording without consent.
If you are out in public, consent is not needed... First amendment... The Constitution supersedes any state law...
