"Criminally loose interpretation" of the Commerce Clause? Fren...they couldn't use the Commerce Clause criminally if the language was originally written to prohibit this. I give you the 2A as a prime example. Ask yourself this, why does the 2A even get into language dealing with this idea of a "Well regulated militia...?). It could have easily just read, "The right of the people to keep and bear Arms and Ammunition, shall not be infringed." I know it sounds like I'm armchair quarterbacking here, and I apologize if that's how it sounds, but I really believe that a "Federalist coup" took place that led to Madison, Jay and the worst...Hamilton to subvert the People's mandate of giving more "Strength and Order" to the Articles of Confederation. Instead they usurped the Convention of the States and gave us a Federal Constitution that basically set up a strong Central Government apparatus.
The Federalists' even tried to get their language ratified without The Bill of Rights! Can you imagine if they had succeeded? What would our country look like without the "After thought" of the Bill of Rights? Would we even have a country right now? Left up to the 3 Federalist Amigos we would have lost our country before it even got going!
I'm not for scrapping our Constitution by any means. Another ConCon would lead to who knows what...same as the first one...however, we do need some serious amendments like term limits, penalty language if you violate your oath of office (it should be a capital offense if you take an oath of office and then proceed to violate that oath...)...the 2A needs to be reworded and the Commerce Clause as well. Oh...and wouldn't it be nice to have an amendment that would strictly forbid Income Taxation which is full on indentured servitude for life and an amendment that takes the power away from legislators to give themselves raises?
