You said that Lincoln violated the yet nonexistent, or in 1864 unsigned Geneva "Convention" (it was the Geneva Treaty). Your statement was factually incorrect.

What occurred in 1860 was a mass organized rebellion and insurrection, not war, hence no need for a declaration of war by Congress. Rather, via the constitutionally enacted Militia Acts, Lincoln called forth the militia for national service (just as Washington did) to fulfill his constitutional duty to suppress said rebellion and protect the property of the United States and the rights of all Americans including those in the rebelling states, which had deposed duly elected officials and taken up arms against the United States.
