good news actuallly, court doesnt solely control the military, president/commander in chief does, kind of looks like a precursor foreshadowing case if trump has to use the military, whatever the court says, or tries to give orders wont work
No. Not good news. That means if the CIC orders them to all slit their own throats, renounce their religion, and have sex with kids, they have to do it.
If they are ordered to kill Americans they have to do it.
There have to be limits to the power of the President.
Slit own throat, depends on circumstance.
Renounce religion no.
Have sex with kids no.
Kill Americans depends on the circumstance.
As far as power goes, the president ranks right under God, and therefore the power is not quite absolute. Which is why we have unlawful orders as a safeguard.
The military has a set of laws called the UCMJ and its own justice system. Those in uniform fall under that, while civilians (everyone who does not serve in the mil is a civilian, including first responders) fall under United States Code and state law. Military also has something called the law of war, or commonly known as the law of armed conflict which we must adhere to during times of war.
Lawful orders are orders which are not illegal, but are required to complete the mission. Unlawful orders are orders which violate the law or law of war.
The supreme court does not make law, they interpret the law.
Until someone specifically challenges it, which could take years, those in uniform must get the jab as long as Biden says if he is commander in chief. That's the way it works, that's what is defined as good order and discipline.
We do, but must fight for them to not be stripped just like everyone else. We are very sheltered and isolated from the shit this country has become while in uniform.
The Military has a set of values that they instill inside of us which makes us competent Americans. When I retired I had to infiltrate American society as an outsider because when Obama was in office he began demonizing us in the military. I had to figure out what my values were as a person and not a Sergeant.
The military is a vocation. That vocation is organized, controlled violence. People do not realize we only make up 1/3 of 1% of American Society. We are aliens to what our society has become. American colleges make trained radical socialists, while the military makes trained radical Americans.
So they are saying, without question that SCOTUS cannot interfere with millitary tribunals.
Sweet!!!

But the religious exemption from the vaccine should be allowed. To deny that exemption is an unlawful order.
Please explain. Thanks for your help to understand.

That's not how orders work.
Ok. So how do they work? The vaccination requirement without religious exemption was an unlawful order.

So members of the Armed Forces have no Constitutional protections? The same Constitution they swore to protect and defend??
