Actually, I don't think anyone specified that the perp has to be breathing. Tell the authorities that you kept the weapon trained on the miscreant 'just in case'. Nobody wants a person who's 'playing dead', to alla sudden jump up and run off, before the first responders can take him (wheel him away) into custody (at the morgue). ;) Better safe than sorry...
