There is no doubt that I am spending way too much time on the internet reading posts. Not to worry, the weather is finally getting warm so I will be not be on the laptop as much.
But until then - here is my dilemma. I have been reading about all the different abortion laws being passed and then blocked by a higher court.
Tonight I had an idea and since I know there are Constitutional people on this board as well as Attorneys, here is my question.....
Would it be possible for a Republican Congress to pass a law that made any embryo a human being as soon as a heartbeat was detected (hopefully at conception, but I digress) and consequently that law would make aborting the baby an actual murder and the person doing the abortion open to arrest for murder?

In some states, if a pregnant woman is murdered, the murderer can be charged with a double homicide. In these cases the Court recognizes the unborn child is a person. Our laws are inconsistent.
I believe they could pass such a law, but lawsuits would inevitably block it until it was ruled on by the Supreme Court.
So, essentially you would need a veto-proof supermajority + favorable SCOTUS ruling (while Biden was President), or a regular majority (if and when the next pro-life President takes office) + favorable SCOTUS ruling.
