Elon's stake is large enough that the hostile takeover is still in play - he can destroy the value in a dump, instill fear in other investors with the THREAT of dumping, and buy up more at a discount... all sorts of things. And we know that he's willing to bend the rules on manipulating stock price and pay the penalty with the SEC - he's had to do that a couple of times, I believe.
So he's really in the drivers seat here, from what I can tell. It will be interesting to see if we get a decision from the board today on whether they will accept the offer or go against the above-price offer.
