Seems to me like someone had a duty to arrest Sussmann the moment they knew he was trying to pass on fabricated evidence. Misdirecting law enforcement assets, at the very least. BTW, why has Durham not made that charge?

Durham is making it clear to Sussman's attorney's that he's toast. Then it's up to them to convey what his choices are. 1) keep waging a winless battle that will be very, very expensive. 2) Roll over onto Hillary, Podesta, etc. in hopes of getting a reduced sentence or 3) Take a long walk off a short pier.
