Chris Miller did respond to the Jan 6th event but it took until 3:45-4:00pm until troops could be coordinated; travel, deputized, etc. If Pence commanded the Nat'l Guard Troops, who were under the direction of Chris Miller, it seems Pence acted over and above the Commander-in-Chief; Donald J Trump.

Scenario One; Pence was considered President of the Senate on Jan 6th, does that mean he had authority to act as Commander-in-Chief when presiding over the Senate/Capitol Building & Grounds on Jan 6th? Hence, it was within his rights to speak directly with the military at the Pentagon?

Scenario Two; Perhaps Trump signed the Insurrection Act and transferred the authority over to Pence and the Military?
