However, a win is a win. It's a miracle that anything positive is happening while Democrats control the whole legislative branch. But to answer your question directly; A 4th conservative justice would've been better, but beggars can't be choosers
It's not a negative, but having SA rule correctly is difficult for me to chalk up as a win... Isn't this what their job is?
The very fact that shit is so bad that we actually are so worried about a trivial case with an obvious result might have a chance to lose is not a positive thing.
Will the EPA stop issuing these directives? If they don't stop and are not arrested and the states abide, then what?
Does the court matter if it they don't abide by the court?
They knew they were breaking our constitution when they did it to begin with. They aren't stupid. They know it takes forever to go through the courts and they can implement their illegal shit while it is. Then once it is ruled on they will tweak their directive and put it right back in play and enforce with the FBI and DOJ until it gets back... rinse and fucking repeat...
SA doesn't matter without FBI to enforce are laws or states willing to put forth laws to remove any FBI power or jurisdiction.
In short... That is what I think the best course of action is. Pass state laws preventing any FBI action within their state borders. CUT THEIR POWER!
take out the FBI.. thats a fucking win...
or become your own Country... which I'll take as well...
Well, that EPA ruling could potentially be used to argue that the FBI as a whole is unconstitutional because they were established by executive order, and therefore don't have the authority that they claim to have because Congress didn't give them that authority
Just need a case to be brought by a state AG with balls

I don't think this sets precedence for shutting down any major institution.
The courts have been extremely reluctant to make ruling against something like that has existed for years.
One thing to stop EPA for overstepping, but it's not putting 80K people without a job and leaving holes in our justice system that could danger lives. As bad as I hate the FBI.
