That's the Betsy Ross flag. The American Flag has 50 stars, not 13. Subtle difference, but facts matter.

Every iteration of the American flag through the centuries is still considered an American flag and may be flown anywhere one would fly the flag, in exactly the same way as the current version. The number of stars is immaterial. The Betsy Ross flag is absolutely the (an) American flag.
