So you're suggesting we get our rights from the constitution/government? No, we don't. And you should surely hope we don't because if we did do you know what that would mean? It would mean the government could take them away. The constitution sets forth a set of protections of our natural rights.

Check out the amendments. Look at the first amendment? Do you actually think it gives us the right to free speech? Look at it closely. What does it say? Do the same for the second amendment. You should notice they are protections against the government infringing on those rights.
