Your daily reminder that the law does not consider conspiracy a "theory".

The law considers conspiracy a CRIME.

Can be misdemeanor, if you're plotting a minor crime. Can be felony, if you're plotting to take over the world and methodically slaughter 80-90% of everyone in it.
