The heart of the Moore case is a formerly fringe legal notion called the Independent State Legislature (ISL) theory. This theory posits that an obscure provision in the US constitution allowing state legislatures to set “time, place, and manner” rules for federal elections should not be subject to judicial oversight. In other words, state legislatures should have the absolute power to determine how federal elections are run without court interference.

Yes, the FOUNDERS inserted "fringe legal notions" all over the US Constitution. Doesn't everybody know that? Everyone knows that the "obscure provisions" in the US Constitution don't matter. Golly gee! It's not like the Founders didn't spend months writing it and rewriting it, and then doing so again. It's not like our country lived under the Articles of Confederation for almost a DECADE to figure out that it was highly flawed and needed to be amended. In fact, the amendments were so extensive they decided to throw the Articles of Confederation out and start all over with the US Constitution!
And do you really think The States goal of retaining power from the federal government, and making their own decisions, was an obscure provision? My Lord, that was almost the ENTIRE POINT of the US Constitution. It was the single biggest goal, because our Founders single greatest fear was an all powerful centralized government!
