Judge is probably doing the right thing.
If someone sues you for defamation, it is in your best interest to prove that what you said/wrote was actually true, and therefore not defamation.
You can SAY you have "evidence," but where did it come from? What is the chain of custody of that evidence?
Seems like it is a necessary element in defending against the lawsuit.
