The opinion of a prosecutor is sufficient for this. Prosecutors in Germany are subordinate to the respective Minister of the Interior and must follow his instructions; Germany is not and never was a state with an independent judiciary.

That's ironic they're sanctioning Poland for not having an independent judiciary.
