First, there must be a vacancy in that office which could by achieved by enticing Kamala to resign but then a concurring vote to approve the replacement would be required from both houses of congress.
Between now and January 3, 2023 the Senate is equally divided and if the current vice president resigns she is not available to break a tie. After January 3, the House will be in Republican control and possibly the Senate also. So my recommendation would be for Biden to get started by having Kamala resign immediately and we could simply do without a vice president until President Trump is sworn in in 2024 along with whoever he chooses as his vice president. In the meantime, if Biden checks out early, the Republican speaker could move up.
