This will impact ALL STUDENTS--homeschool, private school & public school children

(19) Elementary school The term "elementary school" means a nonprofit institutional day or residential school, including a public elementary charter school, that provides elementary education, as determined under State law.

It refers all definitions to http://uscode.house.gov/view.xhtml?req=(title:20%20section:7801%20edition:prelim)

And this can be construed to any school a State decides. We need HSLDA opinion on this, but it doesn't sound good for anyone.
