And if they do anyway then what? The damage is done and the hospital goes "well sue us then."

Then you have legal documents that you can use to sue them for a lot of money. Potential lawsuits are an extremely good deterrent, the hospitals dont want to lose mass amounts of funds. They cant feign ignorance that you didn't want the vaccine.
