The case isn't being decided on 1/6, try to get facts straight before putting out these hyperbolic headlines. It's going to be decided whether it goes to a HEARING on 1/6. If it does, then AT A LATER DATE they hold a hearing where attorneys for both sides are asked questions about the case by the Justices. THEN, at some later date AFTER the hearing, the case is decided among the Justices, likely the following week if I understand the calendar correctly.
Yes you are right. But my understanding is that because it is a matter of national security, the Justices can decide the case whenever they want to, including on 1/6 or even earlier!
It's not a decision. It's a vote on if the case can move to a full 9 Justice hearing. The hearing will be the decider, not the 1/6 date. 4 Justices need to vote in the affirmative to move it to a full hearing, and I don't see any real reason this doesn't get moved to a full hearing. If all 9 Justices vote to move it forward, this will send the DS over the edge.
