I am just going to take a wild guess here, so bear with me.
The Plaintiff is requesting to examine 50 random ballots from a precinct of their choice in Maricopa county. What if they already know which precincts are filled with bad ballots?
There are millions of ballots to choose from. By selecting a small number, it doesn't give the defense much of a chance to determine which precinct or where the ballots will be selected from. It makes it hard to cover all the bases as they say.
By choosing 50 ballots, this seems like a fairly innocuous request, which should make it easier for the judge to approve. It also will save tremendous time.
If, with this 50 ballots, fraud is uncovered, we will have our second court win. The FIRST is actually getting a judge, any judge, to do anything other than scream laches or moot. The second would be actual DISCOVERY.
If fraud is discovered, I can pretty much guarantee you that a request to examine all ballots will be requested. Using the precedent of a judge ruling it is okay to examine ballots for fraud, this additional request should be much easier than going for the whole thing right out of the gate.
