You can and maybe should fight for there to be less strict rules for what counts as what strength of evidence, but the judge did nothing judicially unusual. Witnesses are a great way to overcome a lack of hard, physical, data-driven evidence. And lie-detector tests are iffy and very seldom used, so... Lake failing to come up with a witness willing to say what needs to be said to move the process along is on Lake's legal team.
