Up until the last shot of Tate, he looks to be not cuffed, nor in custody. However, the last few seconds is cut to make you believe that he is in police custody. Now for the audio, I don't speak Romanian or whatever dialect that is being spoken.

I did dig up some headlines, arrested in Romania for suspecting human trafficking, possibly a woman being held against her will, investigating a local policewoman or ex policewoman, and Tate is saying he was swatted not arrested for trafficking. All speculation at this point, but I guess a person can have hope based on a YouTube Short.
