Bad guy showed no threat to anyone as he was walking out the door. Bald guy could have been ready to fire if he turned around. And, what if he misses and hits patrons?
As much as I hate to say it, I have a feeling that bad guy's family sues for wrongful death or manslaughter and wins in this fucked up society. Part of the training is also knowing when not to shoot, for many reasons.

The good guy trained to be in a shooting, not a shoot out.
