It does protect the right to protest. If you remain in the road and refused multiple lawful orders to move, you aren't Jay Walking, you're disorderly which is a crime. Can't prevent the flow of traffic unlawfully.

She knew what she was doing and purposely got herself arrested to bring awareness to the 6th.
